Mayor Barnett called to order the Village Council meeting at 7:00 p.m. and led those in the room in the Pledge of Allegiance to the Flag. He explained the protocol for the meeting and the guidelines to submit public comment.

Village Council Questions/Comments
Commissioner Tully thanked this Council and prior councils for their work to negate stormwater challenges in Downers Grove. He noted that the investments have made remarkable improvements in the community.
Commissioner Hosé added that the stormwater utility fee will be $17.31 per ERU, noting that it varies based on the impervious space on each property.

Mayor Barnett explained that the items on the Active Agenda have been discussed at least once, some many times. He encouraged all that are interested to spend time on the agenda online to get additional details. The Mayor noted that this motion and the next are cleanups of the Municipal Code, explaining they are state-driven adjustments.

Commissioner Tully noted that there are two items on the agenda that are of the most interest for each of the Herrick and O’Neill Middle school items. One of which involves rezoning the properties and the other adopting prospective institutional master plans. He stated that he thought the elements for this requested rezoning ordinance were met by the petitioner.

Public Comment
Downers Grove Township Supervisor, Paul Coultrap, spoke about his concern of the Herrick Middle School zoning changes causing issues at the Township by increasing the vehicle traffic cutting through their parking lot to get to the surrounding areas. He asked for the Council to reconsider approving this item.
Downers Grove Township Trustee Dave Ricordati reiterated the issues with possible congestion issues in the Township parking lot if the rezoning is approved. He noted that the parking lot is already crowded at the Township Senior Center during their events.
Village Council Questions/Comments:
Commissioner Tully explained this is the masterplan for the parcels involved in the rezoning request. He further explained that a referendum passed to support the transition for both Herrick and O'Neill Middle Schools to go from seventh and eighth grades to sixth, seventh, and eighth grades He noted that with the increase in students would come additional traffic. The Commissioner said he believes the plan is a good way to manage the situation, especially the circle drive attempting to separate buses from cars and cars from people. Commissioner Tully said he has confidence that the Village, Township, and District 58 will work together on any issues that there may be. He credited District 58 for the plan. Commissioner Tully expressed the importance of safety. He said that the Council and Village staff hears the Township and until they see how this works out, issues cannot be addressed. He also stated the Village can work with them on the separate issue of people cutting through the Township parking lot. He said that with the addition of a grade level to the middle school, it was known that there would be additional traffic.
Commissioner Sadowski-Fugitt stated she agrees with Commissioner Tully. She said given the options, this was the best one to separate the buses from traffic and she believes this is the safest plan.
Mayor Barnett said that school pickup and drop-off is a always a challenge. He said to keep in mind that all can work together to make this work. He also noted that there may be scheduling adjustments during those times.

Public Comment
Jennifer Galvan, resident, expressed concerns about 59th and Blodgett, the circular drive, and the visibility of students and pedestrians crossing.
Phil Bolton, resident, expressed concern with the time of year that the traffic study was completed. He was also concerned with the plan to have the busses cued up, the lack of parking, and issues with blocking 59th Street.
Erik Baker, resident, suggested a reconfiguring of the plan with an arc drive and expressed. He also expressed his concern about parents heading to the south lot when they are coming from the intersection of Fairmount and 59th Street.
Charles Shantz, resident, asked the Council to consider expanding Fairmount Ave and the walking path by the southwest side of O’Neill Middle School to alleviate traffic issues. He further suggested that it could also alleviate the bus issue and consideration should be made to only have it open during school hours and gated when school is closed.
Kevin Russell, Superintendent of District 58, reiterated to the Township that the District is willing to work with them on the issues mentioned. He provided a history about the school enrollment, stating that at both schools they have added a third more of the total number of students. He addressed the concerns about the parking and bussing plans, stating that there are more buses at O’Neill because of the special education classes and specialized programming held at the school. Dr. Russell also explained that student safety was the most important part of the plan, then traffic and the preservation of green space. He explained there was a process to get to where they were and explained this started with the passing of the referendum. He said during the process, the issue of separating busses from traffic was one of the main concerns. Dr. Russell spoke about the traffic studies and explained that the traffic study was intentionally completed in March, in the best interest of the students. He explained that neighborhood meetings were hosted, and during those meetings, the district explained they were looking to direct traffic on Fairmont between O’Neill and Herrick as much as possible. Dr. Russell explained that he spoke during the Plan Commission meeting as well. He also explained why there was not an arch drive for the busses and justified how the area will be used for the busses to loop around the school and alleviate traffic issues on 59th in the morning. He then noted the process for busses in the afternoon and spoke about the concerns with safety issues due to visibility. Dr. Russell said that staff would be assigned to work in the area and assist with crossings. He assured the Council that safety, traffic, and preserving the green space were all of high priority. Dr. Russell concluded by stating that the schools are always looking into student safety.
Village Council Questions/Comments
Commissioner Sadowski-Fugitt said she appreciated the explanation given by Dr. Russell. She said she still has concerns with this plan. She said the east edge of Blodgett Avenue, as shown on the map in the agenda packet, poses safety issues in the green space. She also addressed the stormwater issues in the south area, also explaining she thinks there may be stormwater issues on the whole property. Commissioner Sadowski-Fugitt said she is concerned about the safety of the students with bus drop-offs and does not like the idea of using staff to monitor these areas. She said she prefers getting the busses off of 59th Street in the afternoons. Commissioner Sadowski-Fugitt stated the plan does not address the idea of adding bus lanes to 59th Street and she thinks having busses, cars, and bikes all on the same road is not safe. She said she would prefer to see a more robust analysis of the other options and thinks safety trumps the green space on the north side of the school. Commissioner Sadowski-Fugitt said she would be interested in more time for the Council to analyze other options.
Commissioner Tully said that one thing for consideration was whether the appropriate terms and conditions had been imposed on the approval to protect the interests of the surrounding property owners, the residents, and the general public. He expressed that many of the concerns raised by the residents were not consistent, which added to the layers of this project. He said that safety is of paramount concern. The Commissioner said there will be more students attending the school and the issue is how the extra volume would be controlled. He said there were already challenges at this school and he is confident that District 58 has a direct line to what would work best and they would make adjustments as needed. Commissioner Tully noted that historically with other plans, he has seen that once changes are completed, adjustments can be made if and when they are needed. He said he appreciates the memorandum from Wight that was received on December 14, 2023, explaining why some of the options were not optimal. Commissioner Tully said he thinks this passes the mark for the request being made.
Commissioner Davenport said he sat on the other side of this when he was on the District 99 School Board. He said he had four of his own kids go through O’Neill and is aware of the issues. Commissioner Davenport stated he agrees that this is not perfect, but thinks it is the best solution. He said he has worked with Wight and Company in the past, when with District 99, and he is confident in this plan. He said he believes that all of the concerns that have been brought to the Council over the last couple of weeks, had already been brought to the attention of District 58, and Wight and Company had already responded to them.
Commissioner Hosé said he thinks the standards are met. He stated he also thinks District 58 has gone through the right process and that safety is of the most importance. Commissioner Hosé said he agrees with Commissioners Tully and Davenport.
Commissioner Gilmartin thanked Commissioner Sadowski-Fugitt for her questions. He said he respects District 58 for their plan and process. He said initially he thought it was great, but now he does have some questions. Commissioner Gilmartin stated he believes it is an iterative thing, once in place, will work be done to adjust things if needed. He said he thinks District 58 has the safety of the students in mind. Commissioner Gilmartin said he expects changes to be made if this does not work out, but he said he supports this and asks that District 58 continues to keep safety in mind as they move forward.
Mayor Barnett agrees with the Council members that support this. He said that as questions were raised, the District has addressed them. The Mayor said there would not be a plan in place that would not have questions and concerns. He said he thinks District 58 has considered the concerns raised. He said that there will be ongoing efforts between the Village and the District to keep improving things. The Mayor said he is convinced that District 58 has provided the right considerations and he noted he supports this.

Public Comments
Mike Casella, resident, lives near O’Neill Middle School and asked that the Council table this item. He expressed safety concerns with the car, bus and bike lanes. He also commented on the loss of parking on 59th and a concern for elderly residents that may have issues with services providers due to the lack of parking.
David Matteson, resident, expressed safety concerns with putting a bike lane on 59th Street and asked that it be tabled until there is further input and reflection.
Michelle Bouey, resident, spoke of bikers that use an asphalt paved road through Patriots Park. She stated it runs all the way to 55th Street.
Jennifer Galvin, returned to the podium and stated that many of the resident on 59th Street do not know that this is on the agenda. She asked it be tabled until after the holidays so that there can be more community input.
Village Council Questions/Comments:
Commissioner Tully said that the Bike and Pedestrian Plan is one of the Village’s high priority action items and there has been a lot of support from the community for this. He stated the community is asking for more support of cycling and this has been dedicated by DuPage County as a bike trail that runs through Downers Grove. Commissioner Tully said Option D is consistent with what was discussed for the plans at O’Neill. He explained that 59th Street is different from other streets and that is why this is being discussed. Commissioner Tully said there is less parking on the street on 59th Street than in other places. He stated that this is compatible with what is being proposed to be done at O’Neill. He explained that all of the Village Boards and Commissions are recommending boards. He noted that the Council makes the final decision. Commissioner Tully said he thinks that Option D is the appropriate option, but if the Council wants to wait until furthering the Bike and Pedestrian Plan to look at this, he is also fine with that.
Commissioner Sadowski-Fugitt said this was designated by the County as a bike through-route and with the schools there, it should be well-used. She said the street is wide and there is enough room to buffer the lane, which she thinks is a safer option than sharrows. Commissioner Sadowski-Fugitt asked Village staff to have targeted police enforcement to be sure people stop at stop signs. She said she thinks 59th Street lends itself well to dedicated bike lanes and said she hopes her daughter can ride her bike once she goes to middle school. Commissioner Sadowski-Fugitt stated that after Traffic Study #9 it was determined that bike lanes were safer than sharrows for this area. She said she is a resident of the area and she received a letter in the mail about the TAP Commission meeting about a week prior to the meeting. Commissioner Sadowski-Fugitt said as part of the process, this went through the TAP
Commission and it now falls on the Council to make the final decision.
Commissioner Gilmartin added that 59th Street and Fairmount were identified in the 2013 Bike and Pedestrian Plan as strong areas. He said he agrees with Commissioner Tully that the Council should move forward and make this the start of the process to make the town a bike and pedestrian town. Commissioner Gilmartin said he supports this.
Commissioner Hosé stated he appreciates the feedback from the neighborhood. He said if there were an area to have a separate bike lane in the community, this area would seem to make sense. He noted that there already is one dedicated by the County. Commissioner Hosé said he appreciates the comments that stop signs need to be adhered to by bikers, as well as by people that drive cars. He stated he does not believe it should be tabled and supports this.
Commissioner Davenport stated he agrees with what has been said. He noted he thinks the safest place for a bike is on a trail and off the street and hopes that will come out of the Bike and Pedestrian Plan update someday. Commissioner Davenport said he supports this for now.
Commissioner Tully said that he wanted to quill the concerns the residents had about not being able to park on 59th Street over the holidays, so he asked Manager Fieldman when it would go into affect, if approved.
Village Manager Dave Fieldman said the summer of 2024.
Mayor Barnett noted that he agrees with Commissioner Davenport. He said he is skeptical and does not think this is for groups of professional bikers. The Mayor said he thinks this is about allowing the community the option to bike or walk, over driving, within the community. He said he believes a physical separation of bikers and pedestrians from
motor vehicles is the best option. Mayor Barnett is in favor of trying to improve the Bike and Pedestrian Plan.
Commissioner Tully said he would make a motion to amend the current motion to have it become a part of the Bike and Pedestrian Plan or to delay it until more work is done on the high priority action item.
Mayor Barnett said that would be his preference

Commissioner Hosé said it was easier this way, then it would be to table the item - which would be non-debatable. He said this way everyone can be heard.
Commissioner Gilmartin said he does not love delaying this, but he understands why. He said he wants to move forward with this opportunity but respects the Council waiting until discussing the entire Bike and Pedestrian Plan. He also noted that would allow for more input from the community. Commissioner Gilmartin said he thinks it is the right decision but asked that everything in the 2013 Bike and Pedestrian Plan be reviewed first.
Manager Fieldman said that in the scope of the contract with Houseal Lavigne (approved earlier in the meeting), one of the first action items in the Bike and Ped Plan update is to review, discuss, and analyze the recommendations of the 2013 Plan.
Commissioner Sadowski-Fugitt said she regrets that sharrows were placed on Prairie. She spoke of decisions making some residents unhappy, but that decisions have to be made that improves community as a whole. Commissioner Sadowski-Fugitt said that bike lanes will make transit safer and agrees when there is an actual Bike and Pedestrian Plan in place, it will provide information that they do not have now. She said she thinks 59th Street is a good place for this bike lane because of the schools, but she is okay with delaying it.
Commissioner Davenport stated he is much more comfortable with the amended motion and thanked his fellow Commissioners. He said he is anxious to get the Bike and Pedestrian Plan implemented in the right way. He noted he thinks there is enough room on 59th Street to have cars driving both ways, parking on one side of the street, and also an off-street path. Commissioner Davenport said he thinks it is better to wait.
Mayor Barnett explained that the Bike and Pedestrian Plan is going to be more robust and cautioned that not everyone will agree with the plan, but that the Council always puts in a lot of thought, planning, care and concern for the community when making these decisions.

Public Comments
Robert Cassenis, resident, expressed concerns about having parking issues in the neighborhood already and is concerned that there will be more issues with this.
Commissioner Hosé reminded all that the motion made was to maintain current conditions and study it further as part of the Bike and Pedestrian Plan.
Jennifer Galvin, returned to the podium and stated she is opposed to this, stating that there would be parking issues for residents and for the extra traffic at O’Neill due to the rezoning. She spoke about what she considered a violation of due process rights for the residents by eliminating parking.
Mayor Barnett reminded all that the current motion is to delay this and discuss it during the Bike and Ped Plan update process, which is a broader discussion and would include public hearings.
An unnamed resident, spoke against this and about the speeding in this area. He said that removing the parking will do nothing to help slow cars down. He asked the Council to reconsider.
Lynn Konsbruck, resident, is concerned about the no parking ban and where people will park if they come to her house.
Michelle Bouey returned to the podium and asked if speed bumps can be used to stop the speeding.
Dan Johnson, resident, thanked the Council and Village for considering ways to improve safety and speed compliance in his neighborhood. He said he thinks this is an overreaction to the issue and that eliminating parking will cause more of a speeding problem.
Steve Wenke, resident, spoke of contacting the Village in the past due to issues with some of the grading of the sidewalks in his neighborhood. He also expressed concerns that if this passes it will cause other issues in the area and visitors will no longer by attracted to the area. He asked the Council to reconsider.
David White, resident, stated if this passes it would pose issues for pedestrian safety.
Cathy White, resident, expressed concerns with this because of personal physical disabilities. She stated that if parking is removed, it will affect her ability to park and walk to her house safely.
Rich Ryder, said he choose to live on a side street because of the ability to park on the street. He said he holds garage sales and donates the money, this will affect people attending them.
Village Council Questions/Comments
Commissioner Tully clarified that the current motion is not the original, it was amended to maintain the status quo for now and include this as part if the broader Bike and Ped Plan discussion. He also explained that the motion does not address the speeding issues that residents have raised, adding that will need to be addressed in the future. Commissioner Tully said he does not think Fairmount is the same as 59th Street and he would consider Option B.
Commissioner Hosé said the reason behind the motion was to make it clear that the Council heard the neighborhood. He said he is not interested in speed bumps, but does know that speeding is an issue. He said he too is interested in Option B. Commissioner Hosé explained that this process is talking about what to do with a right-of-way, not personal property. He said he is interested in seeing what else the consultants come up with regard to the Bike and Pedestrian Plan.
Commissioner Sadowski-Fugitt said she thought that the median was the best option to narrow the road and slow down traffic. She said she gets tailgated a lot on Fairmount. Commissioner Sadowski-Fugitt noted she hopes the median is a part of the consideration when going into the Bike and Pedestrian Plan. She said there are no cross streets, which is why people speed so much. She asked if there are right-of-way spots that can provide a connection to the neighborhood around it.
Commissioner Davenport said he is glad that nothing is changing. He said he does not think getting rid of parking is good for the reasons stated this evening. Commissioner Davenport said he thinks they need to reduce speeds and the median at the center of the street, Option B, is attractive and slows traffic.
Mayor Barnett reminded everyone that the materials related to this item and the others discussed in this meeting, and those prior, are in the agenda packets online at downers.us. He said the public is welcome to email the Council with questions as well.
Commissioner Gilmartin thanked all for coming and sharing their thoughts. He said that even though no action was taken at the meeting, he is interested in moving the Bike and Pedestrian Plan forward. He stated that the goal is to look at this street and other streets for opportunities. Commissioner Gilmartin noted that non-motorized transportation is evolving. He said he believes back in 2013, it was in the plan and it is being looked at now. He noted that studies show economic growth in communities that have more bike and pedestrian safety and connectivity. Commissioner Gilmartin said feedback from the community is welcome and the Council looks for it. He encouraged everyone to stay tuned with the website and subscribe to the newsletter. Commissioner Gilmartin noted this is put on pause for a little while but not forever, and he stated he is excited about the consultant and the conversations to be had.
7. Manager’s Report
Village Manager Fieldman used a PowerPoint presentation to provide a status update of the Villages Priority Action Items. He said that three projects have been completed including Update the Enterprise Resource Planning System, Update the Building Codes, and Public Safety Pension Stabilization. Manager Fieldman said work continues, but is behind schedule, on the Meadowbrook Tax Increment Financing (TIF) and Redevelopment Agreement (RDA). He said work continues on the Ogden TIF, Lead Service Line Replacement Plan, Review of Diversity Equity Inclusion (DEI) Practices (focusing on the Village as the employer), Video Gaming, Comprehensive Plan and related projects. Village Manager Fieldman said conversations about the Bike and Pedestrian Plan can happen as early as January and work continues on the Civic Center Project.
Deputy Village Manager Mike Baker gave an update on the Civic Center Project and said it remains on schedule and under budget. He shared a video of the recent progress.
Mayor Barnett explained that Lot 2 of the Civic Center Project will be sold for redevelopment and he explained the pension smoothing process.
8. First Reading
ORD 2023-10138 — A. Ordinance: Extending the Term of the Ogden Avenue TIF District and the Ogden Avenue
Corridor Redevelopment Project Area for the Village of Downers Grove, Illinois
Village Manager Fieldman gave an explanation of this item. He explained that the revenue generated and received during the extension period would be distributed to other taxing bodies.
9. Attorney’s Report
Pursuant to Section 2.5 of the Downers Grove Municipal Code, Village Attorney Enza Petrarca presented the following for Village Council consideration:
- 1. An ordinance extending the term of the Ogden Avenue TIF District and the Ogden Avenue Corridor Redevelopment Project Area for the Village of Downers Grove, Illinois.

Commissioner Hosé stated that the Village of Downers Grove is the cream of the crop, giving examples of the AAA Bond rating, the Police and Fire Departments in the top 1% of the country, the Civic Center is on time and under budget, the impact of public safety pension increases are being smoothed out, and joining the Greenest Region Compact. He concluded wishing a Happy Holidays to all.
Mayor Barnett read a statement and told all that this is the time of year when friends and family connect and reconnect over shared good wishes, no matter what holiday is celebrated. He stated as Mayor, he has had the privilege of sitting in the center chair during the holidays and encourage all to focus on love, putting each other first, giving each other space and grace, and focus on the good that is in everyone. He said to put aside differences and celebrate the things which make everyone alike. He stated that a message from President Obama has stuck with him – the message of Christmas extending beyond those who celebrate their faith during the season, reminding everyone to treat each other the way they want to be treated, and that Christmas is a message of unity, decency and hope. He said the Village is made up of good people, from many backgrounds, and many beliefs that share a love of the community. To succeed in making tomorrow better than yesterday, he said the love of the community needs to manifest itself into a love for one another. The Mayor expressed that he hopes the new year fills all with understanding, forgiveness, and grace. He said he wishes the community, his colleagues, and the Village team members a very Merry Christmas and a Happy New Year.
