1. Call to Order
Mayor Robert Barnett noted most of the Council members would be operating by conference call from their homes. Village Manager Dave Fieldman, Deputy Village Manager Mike Baker, Village Attorney Enza Petrarca, Village Clerk Rosa Berardi, Community Development Director Stan Popovich, Doug Kozlowski and Megan Miles are in the Committee Room.
Mayor Barnett called to order the Village Council meeting at 7:00 p.m. and led those in the room in the Pledge of Allegiance to the Flag. He explained the protocol for the meeting and the guidelines to submit public comment.

3. Presentations - Economic Development Corporation Quarterly Report
Economic Development Corporation President and CEO, Michael Cassa reviewed the EDC quarterly report, summarizing that municipal sales tax for August was up 7.07% over a year ago, but home-rule sales tax was down 5%. Hotel taxes and food and beverage taxes were also down. Mr. Cassa discussed EDC's Retention Outreach Program to the businesses, the partnership between the Village and the EDC to promote food takeout / deliveries, and he spoke about some of the development projects within the Village that have been either completed or were ongoing. Mr. Cassa announced that Corelle Brands, a larger manufacturer of kitchen/household products, is locating its corporate headquarters to Highland Landmark in Downers Grove.
Other items the EDC was working on included its development plan and strategic plan. Questions followed on whether Mr. Cassa heard if restaurants were weighing whether it was feasible to stay open or close temporarily.
4. Manager's Report
Village Manager Fieldman summarized the Village's updated financial response to the COVID pandemic. He shared slides with the Council, reminding them of the 4-tiered approach that was adopted to address revenue shortfalls. More recently, however, he reported the Village would only be using Tiers 1 and 2 to address the Village's revenue shortfall. Further information on revenue streams followed with sales tax revenue continuing to be monitored. Home Rule sales tax was down; food and beverage numbers also followed, with Manager Fieldman reporting that not much recovery would be gained in the hotel tax revenue. General revenue would be down with an estimate close-out for 2020 at $45.0M dollars. Per Manager Fieldman, continued monitoring of the various revenue streams will take place. In closing he indicated that staff has closed the financial gap by controlling expenses in the general fund and by obtaining the Federal Cares Act grant of over $2.5M dollars provided through DuPage County.

8. First Reading
Addressing Items A, B, and C below, Community Development Director Stan Popovich located the site on the overhead for Commissioners, pointing out that the current site included a one and two-story building. Current access to the site was noted. Per Mr. Popovich, the petitioner was proposing to construct a 9,000 sq. foot building located in the middle of the site, which included five tenant spaces and a drive-through on the east side of the building. Reviewed were future access points, site improvements, parking improvements, signage, and elevations, building materials and building parapets. The proposal met the requirements of the Village's comprehensive plan. The Plan Commission supported the rezoning and special use.

EDC President and CEO, Michael Cassa addressed the Council and explained that under the redevelopment agreement the Village would reimburse the developer in an amount not to exceed $850,000.00 for eligible redevelopment costs from the Ogden TIF fund with reimbursement to be made upon substantial completion of the redevelopment project as well as submission of no less than two signed leases for restaurant tenants and submission to the village of requisitions for eligible redevelopment costs. Key terms of the agreement also followed. Mr. Cassa extended thanks to Vequity for reinvesting in the Village with its fourth project.
Commissioners and Mayor Barnett thanked Vequity for investing in Downers Grove, thanked staff for their work, and also for Vequity providing a bike rack.
Mr. Chris Lake (phonetic) with Vequity, also appreciated the support and opportunity to work with the Village.
ORD 2020-8781 - E. Ordinance: Make Certain Amendments to the Mobile Food Permitted Location Map

Manager Fieldman summarized that this ordinance expands the locations of where food trucks are permitted to operate. Specifically, the proposed area is bounded by the center line of Rogers Street on the north, 703 Rogers street on the west, Douglas Street on the east and the railroad tracks on the south. The area is adjacent to a residential community. The Chamber of Commerce No. 630 supported the ordinance.
Commissioner Walus shared her comments about the Village's Legal Department sending Goldfinger an email in October 2019 explaining that mobile food trucks were not allowed to operate in the 513 Rogers area pursuant to Section 8-17 of the municipal code. Further, she noted that in an article in www.ChooseDupage.com (July of 2020) it stated that guests could bring their own food because food trucks would be set up in the parking lot, after staff indicated to Goldfinger that they could not operate in the area. She supported the amendments, especially during such trying times.
Commissioner Earl echoed the same comments, but pointed out this location was different than the locations approved in 2016.
Other commissioners shared that residents looked forward to having the trucks. Approving the ordinance leveled the playing field for Goldfinger and it also met the Village's policy where residents could eat food while consuming alcohol. The change would add value.
Commissioner Gray thanked Commissioner Kulovany for bringing the ordinance forward and for a well thought-out idea. He believed it was helping local businesses.
Commissioner Hosé provided positive comments on this matter even though he was supportive of the restrictions that were in place.
Mayor Barnett also supported the change and reminded everyone that food trucks can be an initial startup for an entrepreneur.

A special thanks to Commissioner Kulovany for his clear understanding of the needs of business, especially during the current treacherous environment, and for bringing this option to the attention of Council.
