1. Call to Order
Mayor Robert Barnett called the regular meeting of the Village Council of the Village of Downers Grove to order at 7:00 p.m. in the Council Chambers of the Downers Grove Village Hall.
Pledge of Allegiance to the Flag
Mayor Barnett led those present in the Pledge of Allegiance to the Flag.
2. Roll Call
Council Attendance (Present): Commissioner Hosé, Commissioner Earl, Commissioner Walus, Commissioner Sadowski-Fugitt, Commissioner Kulovany, Commissioner Gray, Mayor Barnett
Absent: None
Non-Voting: Village Manager David Fieldman, Village Attorney Enza Petrarca, Deputy Village Clerk Megan Miles
The Council meeting is broadcast over the local FM radio station, WDGC. In addition, a tape recording and videotape of the meeting are being made using Village-owned equipment. The videotape of the meeting will be used for later rebroadcast of the Council meeting over the Village cable television Channel 6.
The Council will follow the rules of conduct for this meeting as provided in Sec. 2.5 of the Downers Grove Municipal Code. These offer the public the opportunity to comment at several points in the meeting. First, immediately following approval of the minutes of past meetings, an opportunity will be given for public comments and questions of a general nature. If a public hearing is scheduled for this meeting, an opportunity is given for public comments and questions related to the subject of the hearing. Finally, an opportunity is given for public comments and questions on items appearing on the Consent Agenda, the Active Agenda and the First Reading.
The Mayor stated that at the appropriate time the presiding officers will ask if there are any comments from the public. Individuals wishing to speak should raise their hand to be recognized and, after acknowledgment from the presiding officer, approach the microphone and state their name. Remarks should be limited to five minutes, and individuals are asked to refrain from making repetitive statements.
Mayor Barnett said there are agendas located on either side of the Council Chambers, and he invited the audience to pick up an agenda and follow the progress of the Council meeting.
3. Minutes of Council Meetings
MIN 2019-8457 - A. Minutes: Council Minutes - December 17, 2019
Motion: Commissioner Hosé moved to approve the minutes as presented. Commissioner Earl seconded the motion.
Mayor Barnett declared the motion carried by voice vote.
4. Public Comments
This is the opportunity for public comments.
1. Cheryl Popielarz stated she lives on Grand Avenue near Whittier School, with St. Joe's Creek running behind her home. Her neighbors have been reaching out to the Village since October of 2017 after the torrential rains that eroded their stream banks. She and her neighbors are concerned that they are no further along than they were two years ago, and are actually set back further. There have been no updates on recent assessments put in the budget and they are concerned with the next steps as their backyards continue to shrink.
Mayor Barnett said he would get an update to the residents as quickly as possible. Stormwater is always a focus and they will receive an update.
2. David Rose said he had a handout for the Council and staff which is a follow-up on prior material he has given on environmental sustainability. ("Logical Simplicity, Historical Difficulty of the Problem of Environmental Sustainability"). He asked whether economic growth is environmentally sustainable, and read portions of the handout that he presented to Council verbatim. Mr. Rose summarized the remainder of his report and left the rest of the material to be read by Council.

Summary: This establishes an administrative procedure to determine eligibility for continued health insurance benefits under the Public Safety Employee Benefits Act.

Motion: Commissioner Hosé moved to adopt "An Ordinance Establishing an Administrative Procedure for Assessing and Determining Claims under the Public Safety Employee Benefits Act (PSEBA)," as presented. Commissioner Earl seconded the motion.
Mayor Barnett asked Village Manager Dave Fieldman to summarize PSEBA.
Dave Fieldman, Village Manager, explained that it is a state mandated program that provides benefits to public safety employees and beneficiaries of employees who have been catastrophically injured on the job.

7. First Reading
ORD 2019-8447 - A. Ordinance: Amend Class "O" Outdoor Liquor License Provisions
Village Attorney Enza Petrarca said this item removes the dining requirements allowing brewing facilities licenses to quality for outdoor licenses. It was forwarded by the Liquor Commission.
Commissioner Kulovany asked about an agreement with a local restaurant regarding food delivery. Attorney Petrarca said this was discussed at the Liquor Commission.

10. Mayor and Council Member Reports
Commissioner Kulovany said that the Downers Grove Historical Society is sponsoring an event on January 22 at Emmett's. He said that Stan Popovich will present the Downers Grove Landmark Ordinance at that event.
Commissioner Gray reminded residents of the Christmas tree pickup/drop off deadlines.

Summary: This makes the following appoints to Village Boards and Commissions:
Architectural Design Review Board
Appoint Amy Gassen to a three-year term expiring August 31, 2022.
Plan Commission
Appoint Steven Toth to a term expiring August 31, 2021.
Motion: Commissioner Hosé moved to adopt "A Resolution Appointing Members to Village Boards and Commissions," as presented. Commissioner Earl seconded the motion.
Commissioner Earl thanked Amy Gassen who has given so much of her time to work on the Village Plan Commission, and is moving to the Architectural Design Review Board.
Commissioner Kulovany commented on the members whose appointments were made by the Mayor.
Mayor Barnett responded to the reading of the Resolution stating he and the Council appreciate all the input they receive from all Board and Commission members.

11. Adjournment
Mayor Barnett asked for a motion to adjourn into Executive Session.
Motion: Commissioner Hosé moved to adjourn into Executive Session pursuant to Section 2(c)(1) of the Illinois Open Meetings Act to consider personnel matters. Commissioner Earl seconded the motion.
Mayor Barnett declared the motion carried by voice vote and the meeting adjourned at 7:26 p.m.
