1. Call to Order

Mayor Pro Tem David Olsen called the regular meeting of the Village Council of the Village of Downers Grove to order at 7:00 p.m. in the Council Chambers of the Downers Grove Village Hall.

Mayor Pro Tem Olsen said Mayor Tully is absent tonight.   

In the absence of Mayor Tully, Commissioner Olsen served as Mayor Pro Tem. 

 

Pledge of Allegiance to the Flag

Mayor Pro Tem Olsen led those present in the Pledge of Allegiance to the Flag.

2. Roll Call

Present:  Commissioner Waldack, Commissioner White, Commissioner Vattimo, Commissioner Hosé, Commissioner Olsen; Commissioner Barnett

Absent:  Mayor Tully

Non-Voting:  Village Manager Dave Fieldman; Village Attorney Enza Petrarca; Village Clerk April Holden

The Council meeting is broadcast over the local FM radio station, WDGC. In addition, a tape recording and videotape of the meeting are being made using Village-owned equipment. The videotape of the meeting will be used for later rebroadcast of the Council meeting over the Village cable television Channel 6. 

The Council will follow the rules of conduct for this meeting as provided in Sec. 2.5 of the Downers Grove Municipal Code. These offer the public the opportunity to comment at several points in the meeting. First, immediately following approval of the minutes of past meetings, an opportunity will be given for public comments and questions of a general nature. If a public hearing is scheduled for this meeting, an opportunity is given for public comments and questions related to the subject of the hearing. Finally, an opportunity is given for public comments and questions on items appearing on the Active Agenda and the First Reading. 

The Mayor Pro Tem stated that at the appropriate time the presiding officers will ask if there are any comments from the public. Individuals wishing to speak, should raise their hand to be recognized and, after acknowledgment from the presiding officer, approach the microphone and state their name. Remarks should be limited to five minutes, and individuals are asked to refrain from making repetitive statements.

Mayor Pro Tem Olsen said there are agendas located on either side of the Council Chambers, and he invited the audience to pick up an agenda and follow the progress of the Council meeting.

3. Minutes of Council Meetings

MIN 2016-6674 - A. Minutes:  Council Minutes - February 2, 2016

Motion:  Commissioner White, seconded by Commissioner Waldack moved to approve the minutes as presented.  

Mayor Pro Tem Olsen declared the motion carried by voice vote.

4. Public Comments

This is the opportunity for public comments.

Andrew Tomson spoke of an administrative fee he was assessed for driving with a suspended license.  He is contenting that his license was not suspended.  He went to an administrative hearing and brought evidence that his license was not suspended, but it was not reviewed and he was fined $500.00.  Mr. Tomson then described difficulties regarding the appeal process.

5. Consent Agenda

BIL 2016-6675 - A. Bills Payable:  No. 6244, February 9, 2016

 

MOT 2016-6664 - B. Motion:  Award a Contract for $15,450 to Elmhurst Chicago Stone, Elmhurst, IL, for Ready Mix Concrete

Summary:  This awards a contract for the supply of ready mixed concrete to Elmhurst Chicago Stone Company of Elmhurst, Illinois as the lowest responsible bidder in an amount of $15,450.

 

RES 2016-6666 - C. Resolution:  Authorize an Extension to the Agreement with 3M Company

Summary:  This authorizes a contract extension with 3M Company of St. Paul, MN until December 31, 2016, for traffic sign materials for a total not-to-exceed $20,000.

MOT 2016-6659 - D. Motion:  Award a Contract for $37,400 to KLF Enterprises, Markham, IL, for Debris Hauling Services

Summary:  This awards a contract for the provision of debris hauling services to KLF Enterprises of Markham, Illinois as the lowest responsible bidder in an amount of $37,400.

 

MOT 2016-6663 - E. Motion:  Award a Contract for $50,000 to K-Five Construction Corporation, Lemont, IL, for Hot Mix Asphalt Materials

Summary:  This awards a contract for the supply of hot mix asphalt materials to K-Five Construction Corporation of Lemont, Illinois, in the amount of $50,000.

 

MOT 2016-6660 - F. Motion:  Award a Contract for $39,080 to Western Gradall Corporation, Naperville, IL, for Roadside Drainage Ditch Reconstruction and Maintenance Services

Summary:  This awards a contract for the provision of roadside drainage ditch reconstruction and maintenance services to Western Gradall Corporation of Naperville, Illinois, as the lowest responsible bidder in an amount of $39,080.

 

RES 2016-6661 - G. Resolution:  Authorize a Contract Extension with TNT Landscape Construction, Inc.

Summary:  This authorizes a contract extension with TNT Landscape Construction, Inc. of Elgin, Illinois, for sod installation and restoration services until December 31, 2016. There is no change in contract cost for this time extension for a contract total not to exceed $73,580.

Summary:  This awards a contract for the supply of crushed limestone to Marcott Enterprises, Inc., of Villa Park, Illinois, as the lowest responsible bidder in an amount of $38,250.

Summary:  Library Board - December 16, 2015; January 13, 2016; January 19, 2016; January 20, 2016

 

Motion:  Commissioner White moved to approve the Consent Agenda as presented.  Commissioner Waldack seconded the motion.

6. Active Agenda

ORD 2016-6637 - A. Ordinance:  Authorize the Village of Downers Grove to Borrow Funds from the Public Water Supply Loan Program of the Illinois Environmental Protection Agency

Summary:  This authorizes the Village to borrow funds from the Illinois Environmental Protection Agency.

ORD 2016-6652 - B. Ordinance:  Provide for the Issuance of General Obligation Refunding Bonds, Series 2016

Summary:  This provides for the issuance of General Obligation Refunding Bonds, Series 2016. 

AN ORDINANCE PROVIDING FOR THE ISSUANCE OF GENERAL OBLIGATION REFUNDING BONDS OF THE VILLAGE OF DOWNERS GROVE, DUPAGE COUNTY, ILLINOIS, IN THE AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $8,400,000 AND PROVIDING FOR THE LEVY AND COLLECTION OF A DIRECT ANNUAL TAX FOR THE PAYMENT OF THE PRINCIPAL OF AND INTEREST ON SAID BONDS

Motion:  Commissioner White moved to adopt "An Ordinance Providing for the Issuance of General Obligation Refunding Bonds of the Village of Downers Grove, DuPage County, Illinois, in the Aggregate Principal Amount Not to Exceed $8,400,000 and Providing for the Levy and Collection of a Direct Annual Tax for the Payment of the Principal of and Interest on Said Bonds," as presented.  Commissioner Waldack seconded the motion.

RES 2016-6679 - C. Resolution:  Support Restoration of Funds for the Meals on Wheels Program

Summary:  This supports the restoration of funds for the Meals on Wheels program.

Motion:  Commissioner White moved to adopt "A Resolution Supporting Restoration of Funds for the Meals on Wheels Program," as presented.  Commissioner Hosé seconded the motion.

Mayor Pro Tem Olsen said an amendment to the Resolution has been proposed as follows:

"Be it further resolved that the Village Clerk be and is hereby authorized and directed to forward this Resolution to the Governor, the Speaker of the House, the President of the Senate, the Minority Leader of the Senate, the Minority Leader of the House and all local State legislators and urge them to support the Meals on Wheels program."

Mayor Pro Tem Olsen asked for a motion regarding the amendment to the Resolution.

Motion:  Commissioner Hosé moved to amend the motion to adopt this Resolution to include the proposed amendment as detailed by the Mayor Pro Tem.  Commissioner Waldack seconded the motion. 

Mayor Pro Tem Olsen asked for discussion on the amendment to the Resolution.

Hearing none, Mayor Pro Tem Olsen asked for a roll call on the motion to amend the Resolution.

Mayor Pro Tem Olsen then asked for discussion on the Resolution as amended. 

Commissioner Barnett said this resolution makes sense given the state of our State, the state of our community and the challenges seniors face.  He said communities are facing enormous problems and there is no silver bullet.  Any situation that causes the State to end up with a budget will result in either a cut in services such as this one or a tax increase.  We will continue to be faced with similar situations.  Anything we can do to assess and cover our needs is time well spent as services will continue to be challenged.  He will support this Resolution.

Commissioner White said he agrees that there are a great number of programs across the State that face similar challenges.  He said he strongly supports this Resolution.  This is a vital public program, not a charity.

Commissioner Hosé said he appreciates the comments made by his colleagues.  This is a vital program and many seniors in Downers Grove and across DuPage County rely on it.  He is pleased we have an appropriation restored in the budget for this.  He thanked his colleagues for allowing this to come forward so quickly.

7. First Reading

ORD 2016-6654 - A. Ordinance:  Authorize a New Bond Registrar and Paying Agent for the Village of Downers Grove

Village Manager Dave Fieldman asked Judy Buttny, Finance Director, to address this item. 

Judy Buttny, Finance Director, said the Village's financial advisor, Robert W. Baird & Co., has recommended that the Village use a bond registrar and paying agent for its outstanding municipal bonds.  This change shifts the risk of the payment process away from Village staff to an expert who would be responsible for making timely payments, processing associated paperwork and resolving discrepancies.  The cost of this service is $6,000 for 2016.

 

RES 2016-6657 - B. Resolution:  Authorize a License Agreement for the Temporary Use of Public Property with the Rotary Club of Downers Grove for the 2016 Rotary Club Grove Fest

Mr. Fieldman asked Stan Popovich, Director, Community Development, to address this item.

Stan Popovich, Director, Community Development, said this is a license agreement with the Rotary Club to hold the 7th annual Grove Festival event.  He showed the location and described the layout and road closures, which are similar to past years.

The Community Events Commission reviewed and discussed the proposed event.  They agreed with staff's recommendations and unanimously recommended approval.

Future Active Agenda

11. Council Member Reports

Commissioner Waldack invited everyone to enjoy the festivities of the Ice Festival in downtown Downers Grove from February 12-14, 2016.  Commissioner Waldack also reported that the Community Adult Day Care Center at Gloria Dei Church, 4501 Main Street, will host a Star Wars Costume Benefit Bash on Saturday, February 20, 2016 from 6:00 to 8:30 p.m.  The cost is $5.00 for an individual or $15.00 for a family.  Information is available at www.communityadultdaycenter.org.  Tickets are available at www.eventbrite.com

Mayor Pro Tem Olsen noted that Friday, February 12 is Lincoln's birthday and Monday, February 15 is President's Day.

Commissioner Barnett said he will be presenting two items of new business.  One is Deer Creek and the watershed and flooding issues.  He would like to talk about partnerships and timelines.  The other item concerns accepting responsibility for Jefferson Street.
