1. Call to Order

Mayor Martin Tully called the regular meeting of the Village Council of the Village of Downers Grove to order at 7:00 p.m. in the Council Chambers of the Downers Grove Village Hall.

Pledge of Allegiance to the Flag

Mayor Tully led those present in the Pledge of Allegiance to the Flag.

2. Roll Call

Council Attendance (Present):  Commissioner Waldack, Commissioner White, Commissioner Vattimo, Commissioner Hosé, Commissioner Olsen, Commissioner Barnett; Mayor Tully

Absent:  None

Non-Voting:  Village Manager David Fieldman; Village Attorney Enza Petrarca; Village Clerk April Holden

The Council meeting is broadcast over the local FM radio station, WDGC. In addition, a tape recording and videotape of the meeting are being made using Village-owned equipment. The videotape of the meeting will be used for later rebroadcast of the Council meeting over the Village cable television Channel 6. 

The Council will follow the rules of conduct for this meeting as provided in Sec. 2.5 of the Downers Grove Municipal Code. These offer the public the opportunity to comment at several points in the meeting. First, immediately following approval of the minutes of past meetings, an opportunity will be given for public comments and questions of a general nature. If a public hearing is scheduled for this meeting, an opportunity is given for public comments and questions related to the subject of the hearing. Finally, an opportunity is given for public comments and questions on items appearing on the Active Agenda and the First Reading. 

The Mayor stated that at the appropriate time the presiding officers will ask if there are any comments from the public. Individuals wishing to speak, should raise their hand to be recognized and, after acknowledgment from the presiding officer, approach the microphone and state their name. Remarks should be limited to five minutes, and individuals are asked to refrain from making repetitive statements.

Mayor Tully said there are agendas located on either side of the Council Chambers, and he invited the audience to pick up an agenda and follow the progress of the Council meeting.

 

PROCLAMATION

Mayor Tully read a proclamation declaring January 18, 2016, as Martin Luther King Day in the Village of Downers Grove, honoring Dr. King's birthday.  He urged residents to recognize it as a day of service throughout Illinois.

Motion:  Commissioner Olsen, seconded by Commissioner White, moved to approve the minutes as presented.

Mayor Tully declared the motion carried by voice vote.

4. Public Comments

This is the opportunity for public comments.

1. Sheila Plemich, 5630 Webster Street, stated that she has a stormwater drainage problem that she believes is caused by the Village, which has not been addressed in a timely fashion.  She provided the Village and staff with a copy of her statement, which she then read into the record.  She explained that the house and property at 5634 Webster, adjacent to her home, were purchased by the Village and scheduled for demolition to remain as open space for flood mitigation.  Funding for this project came from FEMA's HMGP program.  Ms. Plemich explained that her home has never flooded in the 30 years she has resided there, including during the April 2013 flooding.  However, as a result of the Village project adjacent to her property, significant amounts of water are draining towards her home's foundation rather than away from it.  Her sump pump has been running 24/7 since this project began, which is highly abnormal.  She noted that there has been almost 7" of rain since November 30, 2015 and the site was not cleaned up until January 5-7, of 2016.  She indicated that the cleanup was done unprofessionally.    Ms. Plemich originally contacted the Village on December 10, 2015 to explain the situation and provided written documentation and photos to support her complaint.  She said suggestions to solve the problem are not satisfactory and will not remedy the situation.  She asked that the Village correct the situation as soon as possible.

Mayor Tully replied that the purpose of demolishing the house was to take it out of the floodplain.  Public Works staff is aware of the issues and will continue to monitor this. 

2. Victoria Chlupsa, 5627 Webster, said that the house next to her at 5631 Webster is also planned for demolition and she is concerned about having the same problem as Ms. Plemich.  She is especially concerned about the grading issue as water drainage now goes to her back yard.

Mayor Tully thanked her for her comments. He said that both of these homes were in a floodplain.  The intention is not to create new problems. 

 

5. Consent Agenda

RES 2015-6619 - B. Resolution:  Express Intent to Continue Participation in the Suburban Tree Consortium and to Authorize Certain Purchases for FY 2016

Summary:  This continues the Village's participation in the Suburban Tree Consortium and to authorize tree supply and planting services in the amount of $216,000.00 for FY 2016.

RES 2015-6620 - C. Resolution:  Authorize a Second Extension and Amendment to the Agreement with Hampton, Lenzini and Renwick, Inc.

Summary:  This amends an existing contract for native landscaping and natural areas maintenance and monitoring with Hampton Lenzini & Renwick, Inc. (HLR), of Elgin, Illinois in an amount not to exceed $30,000.00, bringing the total contract amount to $99,324.00.

ORD 2015-6611 - A. Ordinance:  Rezone Property at 6035 Middaugh Avenue

Summary:  This rezones the property located at 6035 Middaugh Avenue from R-1, Residential Detached House 1 to R-3, Residential Detached House 3.

RES 2015-6612 - B. Resolution: Approve the Final Plat of Subdivision with Exceptions for 6035 Middaugh Avenue

Summary:  This approves a final plat of subdivision to subdivide a single 150-foot wide residential property into two 75-foot wide residential lots.

ORD 2015-6494 - C. Ordinance:  Establish Special Service Area Number 9 in the Village of Downers Grove, Illinois

Summary:  This establishes Special Service Area Number 9 in the Village of Downers Grove, Illinois for the 35th and Saratoga Subdivision.

7. First Reading

ORD 2016-6633 - A. Ordinance:  Amend Certain Traffic Provisions

Village Manager Dave Fieldman asked Nan Newlon, Director, Public Works, to address this item.

Public Works Director Nan Newlon explained that this ordinance includes four proposed revisions to traffic provisions, three of which were presented to the Traffic and Parking Commission and were unanimously recommended for approval.  These three include Concord Drive, west of Springside, which provides for a three-hour parking restriction along that street.  Downers Grove South High School students park along this street and residents have expressed concerns because they need access for visitor parking.  Residents have expressed their concerns at the Traffic and Parking Commission.

The second revision is Maple Avenue, east of Fairview Avenue, which came about as a result of the reconstructed roadway along Maple Avenue, near the intersection.  This area is striped for left turns from Maple onto Fairview.  Staff proposed that this be restricted to No Parking at Any Time at this location.

The third revision is Blodgett at 60th Street in the vicinity of O'Neill School.  Ms. Newlon said that after looking at the number of pedestrians in that area, this location meets the need of an all-way Stop sign.  Residents have expressed concerns because of the number of students crossing due to both the school and the ballpark in that immediate area.  Residents made their concerns known at the Traffic and Parking meeting.

The last revision is a code change as part of the roadway improvements in the vicinity of Clyde Estates in which two "T" intersections, one located at Washington and Clyde, and the other at Clyde and 60th Place, were created to promote traffic calming.  Stop signs at these intersections were included with the construction drawings.   

 

8. Mayor's Report

Mayor Tully invited residents to attend the next Coffee with the Council to be held on Saturday, January 16, 2016, from 9:00 a.m. to 10:00 a.m. at the Downers Grove Public Library, 1050 Curtiss Street.

Pursuant to Section 2.5 of the Downers Grove Municipal Code, the following are presented for Village Council consideration:

11. Council Member Reports

Commissioner Barnett commented about the stormwater issues and suggested accelerating the plan to review changes made to the Municipal Code regarding regulating sump pump/downspout discharge. 

Mr. Fieldman said these changes were implemented a year ago.  Staff has been monitoring these changes and will present a report to Council soon.

Commissioner Barnett announced that the District 99 Education Foundation Pizza Wars event will be held on Thursday.  It is a seven member pizza cook-off.  He encouraged people to come.

Mayor Tully said it will be held on Thursday, January 14 from 5:30 p.m. to 8:30 p.m. at Downers Grove South High School.  Proceeds will benefit students at North and South high schools.  More information can be found at www.csd99.org.

12. Adjournment

Commissioner Olsen moved to go into Executive Session pursuant to Section (2)(c)(11) of the Illinois Open Meetings Act of consider pending litigation and Section (2)(c)(1) of the Illinois Open Meetings Act to consider personnel matters.  Commissioner White seconded the motion.
