1. Call to Order

Mayor Martin Tully called the regular meeting of the Village Council of the Village of Downers Grove to order at 7:00 p.m. in the Council Chambers of the Downers Grove Village Hall.

Pledge of Allegiance to the Flag

Mayor Tully led those present in the Pledge of Allegiance to the Flag.

2. Roll Call

Council Attendance (Present):  Commissioner Walus, Commissioner Earl, Commissioner Waldack, Commissioner White, Commissioner Hosé, Commissioner Barnett (arr. 7:15 p.m.); Mayor Tully

Absent:  None

Non-Voting:  Village Manager David Fieldman, Village Attorney Enza Petrarca, Village Clerk April Holden

The Council meeting is broadcast over the local FM radio station, WDGC. In addition, a tape recording and videotape of the meeting are being made using Village-owned equipment. The videotape of the meeting will be used for later rebroadcast of the Council meeting over the Village cable television Channel 6. 

The Council will follow the rules of conduct for this meeting as provided in Sec. 2.5 of the Downers Grove Municipal Code. These offer the public the opportunity to comment at several points in the meeting. First, immediately following approval of the minutes of past meetings, an opportunity will be given for public comments and questions of a general nature. If a public hearing is scheduled for this meeting, an opportunity is given for public comments and questions related to the subject of the hearing. Finally, an opportunity is given for public comments and questions on items appearing on the Consent Agenda, the Active Agenda and the First Reading. 

The Mayor stated that at the appropriate time the presiding officers will ask if there are any comments from the public. Individuals wishing to speak, should raise their hand to be recognized and, after acknowledgment from the presiding officer, approach the microphone and state their name. Remarks should be limited to five minutes, and individuals are asked to refrain from making repetitive statements.

Mayor Tully said there are agendas located on either side of the Council Chambers, and he invited the audience to pick up an agenda and follow the progress of the Council meeting.

3. Minutes of Council Meetings

MIN 2017-7227 - A. Minutes:  Council Minutes - December 13, 2016

Motion:  Commissioner White, seconded by Commissioner Waldack, moved to approve the minutes as presented.

Mayor Tully declared the motion carried by voice vote.

Proclamation - Martin Luther King, Jr. Day

Mayor Tully proclaimed Monday, January 16, 2017, as Martin Luther King, Jr. Day in the Village of Downers Grove.  Mayor Tully quoted Dr. King, "We must learn to live together as brothers, or perish together as fools."    

4. Public Comments

This is the opportunity for public comments.

Rich Kulovany, 6825 Camden Road, announced that Landmarks Illinois, Chicago Suburban Preservation Alliance will be meeting on March 11, 2017, at Avery Coonley School at 10:30 a.m.  This group of suburban municipalities meets three times a year.  Following the meeting, there will be a break for lunch and a tour of the school.  A workshop will follow to discuss tax incentives available both for homeowners and the federal investment tax credit for commercial properties.

RES 2017-7224 - C. Resolution:  Authorize an Amendment to the Loan Agreement with the Illinois Environmental Protection Agency 

Summary:  This amends the loan agreement with the Illinois Environmental Protection Agency.

RES 2016-7159 - D. Resolution:  Amend the Downers Grove Compensation Plan by Adopting a Revised Plan Effective January 1, 2017

Summary:  This amends the Downers Grove compensation plan by adopting a revised plan effective January 1, 2017.

MOT 2017-7230 - E. Motion:  Authorize a $30,000 Contribution to the DuPage Senior Citizens Council (DSCC) for the Meals on Wheels Program for FY 2017

Summary:  This authorizes a $30,000 contribution to Meals on Wheels for FY17.

 

MIN 2017-7228 - H. Minutes:  Note Receipt of Minutes of Boards and Commissions

Summary:  Library Board - November 16, 2017; Liquor Commission - December 1, 2016

 

Motion:  Commissioner White moved to approve the Consent Agenda as amended.  Commissioner Waldack seconded the motion. 

Votes:  Yea: Commissioners White, Waldack, Walus, Earl, Barnett; Mayor Tully

Nay: None

Mayor Tully declared the motion carried.

7. First Reading

ORD 2016-7169 - A. Ordinance:  Amend Citation Provisions for Ordinance Violations

Village Manager Dave Fieldman asked Village Attorney Enza Petrarca to introduce this matter.

Village Attorney Enza Petrarca explained that this will allow officers to write a ticket on the scene of an incident as opposed to going through the formal booking process.  It also updates the fine structure as well as other corresponding penalty provisions, and adds a few additional violations to allow officers more flexibility and discretion in the field.  It does not restrict the officers' ability to issue tickets through the formal process.  

Commissioner Waldack noted that there are multiple uses of the word "abate."

 

ORD 2016-7222 - B. Ordinance:  Classify Certain Fire Investigators as Peace Officers

Mr. Fieldman said this ordinance would allow certain designated firefighters to serve as arson investigators. 

8. Mayor's Report

Mayor Tully reported on the DuPage County Stormwater Management Committee.  He said their ongoing project regarding stormwater assessment has been reviewed for key elements such as water quality, watershed management, etc. and levels of service.  He noted that the Committee recommended service level 2; water quality was recommended at a higher service level, Level 3.  He said this plan did not address funding. 

Commissioner Waldack commented that the Village should be careful with respect to priorities due to changes in Washington.

Mayor Tully replied that they still have to be mindful of current laws until the change occurs. 

Mayor Tully then updated the status of Flood Plain Mapping, saying it is still going on.  The revised map is scheduled for release in June 2017.

The Mayor commented that DuPage County is scheduled for an audit by State and federal authorities for NPDES compliance within a couple of months.  They have commenced their own audits of municipalities in DuPage County. 

9. Manager's Report

Mr. Fieldman acknowledged the Pride video that played prior to the start of tonight's meeting.  He thanked staff members who worked on the video.  He thinks they did a superb job. 

Mayor Tully agreed, saying it was an excellent work product. 

10. Attorney's Report

Pursuant to Section 2.5 of the Downers Grove Municipal Code, the following are presented for Village Council consideration:

  • An ordinance classifying certain fire investigators as peace officers by the Village of Downers Grove
  • An ordinance amending citation provisions for ordinance violations

11. Council Member Reports

Commissioner White said the Downers Grove Friends of the Gifted and Talented (FROG) class enrollment has begun.  Classes will begin on January 28.  He provided information with respect to some of the classes and noted that additional information can be found at www.dgfrog.org

Mayor Tully commented on the lame duck session in Springfield.  Staff has been keeping a close watch on what is happening with the budget.
