1. Call to Order

Mayor Martin Tully called the regular meeting of the Village Council of the Village of Downers Grove to order at 7:00 p.m. in the Council Chambers of the Downers Grove Village Hall.

Mayor Tully led those present in the Pledge of Allegiance to the Flag.

2. Roll Call

Staff Attendance: Village Manager Dave Fieldman, Village Attorney Enza Petrarca, Village Clerk April Holden

The Council meeting is broadcast over the local FM radio station, WDGC.  In addition, a tape recording and videotape of the meeting are being made using Village-owned equipment.  The videotape of the meeting will be used for later rebroadcast of the Council meeting over the Village cable television Channel 6.

The Council will follow the rules of conduct for this meeting as provided in Sec. 2.5 of the Downers Grove Municipal Code.  These offer the public the opportunity to comment at several points in the meeting

The Mayor stated that at the appropriate time the presiding officers will ask if there are any comments from the public.  Individuals wishing to speak, should raise their hand to be recognized and, after acknowledgment from the presiding officer, approach the microphone and state their name.  Remarks should be limited to five minutes, and individuals are asked to refrain from making repetitive statements. 

The Mayor said there are agendas located on either side of the Council Chambers, and he invited the audience to pick up an agenda and follow the progress of the Council meeting.

Motion:  Commissioner Neustadt, seconded by Commissioner Durkin moved to approve the minutes as presented.

The Mayor said the minutes were approved as presented.

4. Proclamation

Mayor Tully proclaimed the year 2015 as Conservation in our Community year.

5. Council Member Reports

1. Commissioner Durkin said that in March the Village took advantage of the lower interest rate in the bond market for a savings to the Village of over $400,000.  Last week the Village took advantage of the interest rate again and was able to save another $675,000.  This shows the importance of the Village's bond rating.  He said that in that short period of time the Village saved over $1 million.

2. Commissioner Neustadt announced that Nan Newlon has been named the new Chair of the Illinois Municipal League Public Works Committee, and congratulated her.

MOT 2015-6163 - C. Motion:  Award $159,900.00 to Chicagoland Paving Contractors, Inc., Lake Zurich, IL, for 2015 Street Restorations and Pavement Patching Services

Summary:  This awards a contract to Chicagoland Paving Contractors, Inc. of Lake Zurich, Illinois for 2015 street restorations and pavement patching services in the amount of $159,900.

 

RES 2015-6157 - D. Resolution:  Authorize a Local Agency Agreement with the Illinois Department of Transportation for Fairview Avenue Resurfacing (Project ST-037)

Summary:  This authorizes a Local Agency Agreement between the Village of Downers Grove and Illinois Department of Transportation (IDOT) for the use of grant funding for resurfacing of Fairview Avenue between 55th Street and 75th Street.

MOT 2015-6165 - E. Motion:  Award a Contract for $73,580.00 to TNT Landscape Construction, Inc., Elgin, IL, for 2015 Sod Installation and Restoration Services

Summary:  This awards a contract to TNT Landscape Construction, Inc. of Elgin, Illinois for 2015 sod installation and turf restoration services in the amount of $73,580.

 

RES 2015-6166 - F. Resolution:  Maintenance of Streets and Highways by Municipality Under the Illinois Highway Code

Summary:  This appropriates $1,130,000 of Motor Fuel Tax (MFT) funds for 2015.

MOT 2015-6070 - G. Motion:  Authorize $50,000 to the Downers Grove Economic Development Corporation for Tourism Related Activities

Summary:  This authorizes payment in the amount of $50,000 for tourism related activities to the Downers Grove Economic Development Corporation (EDC) based on the terms of the Village's agreement with the EDC.

Commissioner Durkin stated that it has been four years since Michael Cassa joined the EDC. Commissioner Durkin said he is happy to see that the EDC has not sought hotel/motel taxes.  It is great to see these financial results.

ORD 2015-6073 - A. Ordinance:  Establish Special Service Area #8 in the Village of Downers Grove

Village Manger David Fieldman said that the Manager of the Planning Division, Stan Popovich, would present the first item.  

Stan Popovich, Planning Manager, said that this SSA is for the Nelson Meadow Subdivision, which is southwest of the downtown area near Jefferson and Brookbank.  The SSA allows the Village to levy a special tax on the property owners' homeowners' association if they do not maintain the stormwater management facilities and associated landscaping, retaining areas and grass areas.  This is the last step in approving the Nelson Meadow SSA.  A public hearing was held in February and no comments were made in opposition to this ordinance.

Laurel Bowen, 829 Clyde Drive, said that the properties have not been sold there yet, and asked how funds can be obtained for the SSA. She asked how they could establish an SSA for owners who do not yet own the property. 

Village Attorney Enza Petrarca said that the SSA is established with the present property owner/developer. 

Ms. Bowen asked if an SSA can be established for the Bradley Brookbank area. 

The Mayor said staff would have to look into this issue.

Commissioner Neustadt asked how often the SSA areas are investigated.  Mr. Popovich said there is a three-year maintenance and monitoring program, and reports are submitted to the Village regarding the condition of the areas.  The goal is to make annual inspections.

ORD 2015-6103 - B. Ordinance:  Amend Ordinance #5346 and the Village of Downers Grove Budget for Fiscal Year 2014

Finance Director Judy Buttny presented the budget report saying that revenues have performed better than anticipated in the 2014 budget, and as a result the Village was able to make the transfers to the Transportation Fund and the Risk Fund.  These transfers require a budget amendment.  The Motor Fuel Tax Fund received an additional distribution of $200,000 from the State of Illinois in 2014, which was used to purchase salt for the Village, and this requires a budget amendment.  Revenues from sales taxes were also greater than budgeted in an amount of about $100,000.  In addition, increased expenses and revenues for the refunding of the Fire Station 2 bonds require a revenue entry to show the proceeds and an expense entry to reflect paying off the old higher interest rate bond.  The Library received a donation of $200,000 from Friends of the Library, which was made toward the Library renovation.  In addition, the Risk Fund required a budget amendment of $400,000 for greater than expected claims activity.  All of these budget changes require a budget amendment.

Mayor Tully asked about the motor fuel tax and pointed out that this is a unique situation and should not be expected in the future.

9. Mayor's Report

Mayor Tully said that on Monday, April 6, 2015, Governor Rauner attended the Executive Committee of the DuPage Mayors and Managers Conference meeting with his liaisons to discuss issues regarding threats to municipal revenues.  The main threat is a suggested reduction of 50% of the Village's share of the Local Government Distributive Fund (LGDF).  Every manager and mayor in the room has advocated that they do not want their share of the LGDF depleted, which would result in about $2.4 million to the Village.  That would greatly affect essential Village services.  The mayors and managers said that they wanted to find a way to become less reliant on the State, and some of the things mentioned by the Governor were eliminating unfunded mandates of which there are about 200, reducing barriers to consolidation, and promoting ideas for municipalities to obtain increased local control.  Mayor Tully said that it was a good conversation, and everyone will have to work together to work through these financial difficulties.

Mayor Tully also mentioned it is election night, and extended his gratitude to all candidates for choosing to run for public office.
