1. Call to Order

Mayor Martin Tully called the regular meeting of the Village Council of the Village of Downers Grove to order at 7:00 p.m. in the Council Chambers of the Downers Grove Village Hall.

Pledge of Allegiance to the Flag

Mayor Tully led those present in the Pledge of Allegiance to the Flag.

2. Roll Call

Present: Commissioner Bob Barnett, Commissioner Sean P. Durkin, Commissioner Becky Rheintgen, Commissioner Geoff Neustadt, Commissioner Greg Hosé and Mayor Martin Tully  Absent: Commissioner David S. Olsen  Non Voting: Village Manager David Fieldman, Village Attorney Enza Petrarca and Village Clerk April Holden  T he Council meeting is broadcast over the local FM radio station, WDGC.  In addition, a tape recording and videotape of the meeting are being made using Village owned equipment.  The videotape of the meeting will be used for later rebroadcast of the Council meeting over the Village cable television Channel 6.

The Council will follow the rules of conduct for this meeting as provided in Sec. 2.5 of the Downers Grove Municipal Code.  These offer the public the opportunity to comment at several points in the meeting.  First, immediately following approval of the minutes of the past meetings, an opportunity will be given for public comments and questions of a general matter.  If a public hearing is scheduled for this meeting, an opportunity is given for public comments and questions related to the subject of the hearing.  Finally, an opportunity is given for public comments and questions on items appearing on the Consent Agenda, the Active Agenda and the First Reading.

The presiding officer will ask, at the appropriate time, if there are any comments from the public.  If anyone wishes to speak, the individual should raise their hand to be recognized and, after acknowledgment from the presiding officer, approach the microphone and state their name and address.  Remarks should be limited to five minutes, and asked that individuals refrain from making repetitive statements.

Mayor Tully said there are agendas located on either side of the Council Chambers, and he invited the audience to pick up an agenda and follow the progress of the Council meeting.

3. Minutes of Council Meetings

Commissioner Neustadt moved to approve the minutes as presented.  Commissioner Hosé seconded the motion.

The Mayor declared the Motion carried by voice vote, with Commissioner Durkin abstaining.

Proclamations

Mayor Tully read two proclamations:

He declared the week of June 1-7, 2014, as National Garden Week in the Village of Downers Grove.  The Garden Club is co-sponsoring a program with the Downers Grove Public Library at the American Legion Post on Saratoga Avenue on June 5, 2014, at 7:00 p.m.  The topic is "Hostas on the Small Size."  Attendance is free and people can register by calling the Library at 630-960-1200.

The Mayor then declared June 3, 2014, as Special Olympics Day in the Village of Downers Grove in honor of Jeff Osowski who will be participating in the games.  He extended best wishes to Team Illinois.

4. Public Comments - General Comments on Matters Not Appearing on Tonight's Agenda

William Waldack, 1409 Willard Place, spoke about building the railroads in the 1860's.  Railroad builders hired qualified and credentialed people to survey the land and make maps.  Another talent that was sought was malleability to devise schemes that cost the government a great deal of money.  Mr. Waldack said he was once told by an executive that he had a quality that organizations say they want, but is not really appreciated, and that is integrity.  He always remembered the comment about what organizations really want.  Mr. Waldack then commented on Tom Dabareiner's service to the Community Development Department and the Village.  He said many developers, owners and builders complimented Mr. Dabareiner and his staff.  Mr. Dabareiner's achievements included the Comprehensive Plan and the Zoning Ordinance.  It is a tough job to enforce codes.  He said history tells us what you are looking for.

Matt Larsen, 5830 Lyman, said he is a new homeowner in Downers Grove.  He is the Executive Director of the Illinois Spina Bifida Association.  The Association has partnered with Bill Kay Corvettes and Classics at 2100 Ogden Avenue to hold a raffle.  This year the raffle is moving from Lisle to Downers Grove.

5. Council Member Reports

Commissioner Rheintgen said she, Commissioner Barnett and Shannon Forsythe of the Downers Grove Park District recently attended a community garden tours event throughout DuPage County.  It was interesting to see the different approaches.  She hopes a similar event can be done in Downers Grove.

Commissioner Durkin noted that the Children's Safety Expo 2014 will be held on Saturday, June 7, 2014, at Lakeview Jr. High School, 701 Plainfield Road, from 9:00 a.m. to noon.  It is sponsored by State Senator Christine Radogno and State Representatives Jim Durkin and Ron Sandack, and is free to the public.  There will be 45 booths with information as well as demonstrations and activities.

Commissioner Neustadt reminded everyone of the electronics recycling event on Saturday, June 7 at the Village Hall.  Commissioner Neustadt said a community garage sale will be held at Fishel Park on Saturday from 9:00 a.m. to 5:00 p.m. to benefit the O'Leary family whose daughter is ill.   He also noted that the downtown market will be open as well on Saturday.

Mayor Tully said there are 15 days until GroveFest 2014.  He asked as to the protections and accommodations that will be made with regard to the Main Street train station platform construction.

Dave Fieldman, Village Manager, said this has been considered and he will provide the information to the Council and public.

AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE VILLAGE OF DONWERS GROVE, ILLINOIS, CODIFIED AS CHAPTER 28 OF THE DOWNERS GROVE MUNICIPAL CODE, EFFECTIVE JUNE 15, 2014

 

ORDINANCE NO. 5392 T he Mayor said this is to reconsider "An Ordinance Amending the Comprehensive Zoning Ordinance of the Village of Downers Grove, Illinois, Codified as Chapter 28 of the Downers Grove Municipal Code, effective June 15, 2014," passed and approved May 20, 2014.

He asked for a motion to reconsider the vote taken on May 20, 2014, with regard to the adoption of the ordinance amending the Zoning Ordinance of the Village of Downers Grove, Illinois, Codified as Chapter 28 of the Downers Grove Municipal Code, effective June 15, 2014.

Commissioner Neustadt said he was on the prevailing side of this motion and, therefore, made a motion to reconsider "An Ordinance Amending the Comprehensive Zoning Ordinance of the Village of Downers Grove, Illinois, Codified as Chapter 28 of the Downers Grove Municipal Code, effective June 15, 2014," passed and approved May 20, 2014.

Commissioner Barnett seconded the Motion.

Mayor Tully said the motion to adopt the Zoning Ordinance now appears before the Village Council as if it had never been voted upon.

Commissioner Neustadt made a motion to adopt the Comprehensive Zoning Ordinance of the Village of Downers Grove, codified as Chapter 28 of the Downers Grove Municipal Code, effective June 15, 2014, with the inclusion of language in the Ordinance allowing the maximum building height in the M-1 and M-2 Zoning District to be 37.5 feet.

Commissioner Barnett seconded the Motion. 9. First Reading

Mr. Fieldman asked Nan Newlon, Director, Public Works, to address the motions on the First Reading.

MOT 00-05606 A.  Motion:  Award a Contract for $1,259,500.80 to J Congdon Sewer Service, Inc., Carol Stream, IL, for 2014 Water Main Improvements Contract B

Sponsors: Public Works N an Newlon, Director, Public Works, said staff is requesting that a contract be awarded to J Congdon Sewer Service, Inc. in the amount of $1,259,500.80 for the 2014 water main improvements Contract B.  This is the third water main improvement contract this year.  The contracts represent over two miles of water main replacement.

This project will consist of the installation of approximately 3,200 linear feet of water main replacement, replacement of approximately 51 residential water services, sidewalk and driveway removal and replacement, and parkway restoration.  The locations are Bonnie Brae Avenue from Oxford Street to Lyman Avenue; Lyman Avenue from Oxford Street to 65th Street; and Fairview Avenue from 55th Street to 57th Street.  J Congdon Sewer Service was the low bidder.

Commissioner Durkin said this is very much needed as there have been 17 water main breaks on Bonnie Brae in a 12-month period.  He noted that this work will not displace trees.  He said he will support this. Indexes: Water Main Improvements

MOT 00-05607 B.  Motion:  Award a Contract for $198,653.25 to Swallow Construction Corp., Downers Grove, IL, for Hill and Grand Headwall Replacement

Sponsors: Public Works M s. Newlon said staff is requesting that a contract be awarded to Swallow Construction Corp. in the amount of $198,653.25 for the Hill and Grand headwall replacement project.

Ms. Newlon described the primary task to remove and replace the headwall and grate at this location. The new headwall and grate will allow as much water to enter the storm sewer system as possible, reduce the frequency of clogging, reduce the risk of injury, provide streambank stabilization; and facilitate the installation of remote site monitoring.   She showed a picture of the equipment.

Ms. Newlon said there were three bidders; Swallow  Construction was the low bidder.  The project will start as soon as the schools are out for the summer and will be completed before schools open again in the fall.

Commissioner Durkin asked if the Village has anything similar to the monitoring system.

Ms. Newlon said we do not have anything similar and staff will work with the consultant to optimize our ability to view the headwall and grate at night.

Commissioner Rheintgen said the alarm will address the past challenges of clogging.  She asked if there is an automatic system to lift the grate.

Ms. Newlon said there are automatic lift systems, but they are for very large sites with higher maintenance and operations.  Staff thinks the monitoring system outlined is well suited for this location.

Mr. Fieldman said staff does not plan to raise the grate because it should not clog.

Ms. Newlon added that the design of the material and the grading prevent debris from clogging.

Commissioner Barnett noted that there will still be a lot of debris.

The Mayor agreed.  He said this will be significantly improve the situation; however, he noted that nothing is fool proof.  Indexes: Hill and Grand Headwall Replacement

MOT 00-05610 C.  Motion:  Award a Contract for $650,439.70 to J Congdon Sewer Service, Inc., Carol Stream, IL, for 40th and Washington Drainage Improvements

Sponsors: Public Works M s. Newlon said staff is requesting that a contract be awarded to J Congdon Sewer Service in the amount of $650,439.70 for the 40th and Washington drainage improvements.  She showed the area of the project.

The new storm sewer system will increase inlet capacity and pipe conveyance which will significantly lower flood elevations on 40th Street west of Washington, and on Washington Street north of 40th Street.  Homes in this area experienced structural flooding during the April 2013 storm event.

A call of bids was issued, but based on the original scope, the amounts were significantly over budget.  Staff re-evaluated the original design such that it will still meet the initial objectives.      Indexes: Drainage Improvements

MOT 00-05605 D.   Motion:  Award a Contract for $53,900 to Strand Associates, Inc., Joliet, IL, for 2014 Storm Sewer  Construction Engineering Services

Sponsors: Public Works M s. Newlon said this request accompanies the prior motion regarding the 40th and Washington drainage improvements.  Staff is requesting a contract be awarded to Strand Associates in the amount of $53,900 for the 2014 storm sewer construction engineering services.  This will provide construction observation and resident engineering during the construction of the 40th and Washington drainage improvement project.

Ms. Newlon said four firms were prequalified for storm sewer construction engineering services.  Staff recommends award for professional services to Strand Associates. Inc. Indexes: Storm Sewers, Engineering Services

10. Mayor's Report

Mayor Tully reported out on two items on the agenda of the DuPage County Stormwater Management Planning Committee meeting held earlier today.  On the agenda was the FY 2015 Annual Budget discussion.  The initial budget was presented.  DuPage municipalities were asked to review it.  A survey is open until July 18 and agencies within a municipality have been asked to speak with one voice.  The Mayor said DuPage County staff have been holding meetings with the six districts that make up DuPage County; Downers Grove is split between Districts 2 & 3.  He noted that the feedback is for the FY 2016 budget and beyond.

The other matter the Mayor addressed was the needs assessment.  The County plans to have a first draft of the needs assessment by September 2014.  The Mayor said he will try to bring information back to the entire Council as to what is presented.
