1. Call to Order

Mayor Ron Sandack called the regular meeting of the Village Council of the Village of Downers Grove to order at 7:00 p.m. in the Council Chambers of the Downers Grove Village Hall.

Pledge of Allegiance to the Flag

Mayor Sandack led those present in the Pledge of Allegiance to the Flag.

2. Roll Call

Present: Commissioner Marilyn Schnell, Commissioner Bob Barnett, Commissioner William Waldack, Commissioner Sean P. Durkin, Commissioner Bruce E. Beckman, Commissioner Geoff Neustadt and Mayor Ron Sandack Non Voting: Village Manager David Fieldman, Village Attorney Enza Petrarca and Village Clerk April Holden The Council meeting is broadcast over the local FM radio station, WDGC . In addition, a tape recording and videotape of the meeting are being made using Village owned equipment. The videotape of the meeting will be used for later rebroadcast of the Council meeting over the Village cable television Channel 6.

The Council will follow the rules of conduct for this meeting as provided in Sec. 2.5 of the Downers Grove Municipal Code. These offer the public the opportunity to comment at several points in the meeting. First, immediately following approval of the minutes of the past meetings, an opportunity will be given for public comments and questions on the active agenda items for this evening’s meeting. Following this, an opportunity is given for public comments and questions on any subject. Finally, if a public hearing is scheduled for this meeting, an opportunity is given for public comments and questions related to the subject of the hearing.

The presiding officer will ask, at the appropriate time, if there are any comments from the public. If anyone wishes to speak, the individual should raise their hand to be recognized and, after acknowledgment from the presiding officer, approach the microphone and state their name and address. Remarks should be limited to five minutes, and asked that individuals refrain from making repetitive statements.

Mayor Sandack said there are agendas located on either side of the Council Chambers, and he invited the audience to pick up an agenda and follow the progress of the Council meeting.

4. Public Comments and Questions

A. Comments and Questions on Active Agenda

Bill Wrobel, 7800 Queens Ct., commented that he took note of Commissioner Durkin’s statement at the last meeting regarding the Change Order for McCollum Park. He said this item is not on this week’s Active Agenda, but is under the Attorney’s Report and staff will request the one-week waiting period by waived. He said he has spoken before about change orders. Mr. Wrobel commented that we have a Congress now with nothing in the budget engaged in deficit spending, somewhat like this Village Council. Stormwater is like this as the Village borrowed the money for those projects. He heard last week that a change order is standard operating procedure and happens all the time, and is accepted. He does not understand how this could be a public park operated by the Park District, and substandard material was not found previously. He said he thought this should have been determined previously and asked if the Council has heard back from staff about this. Mr. Wrobel wanted to know why it is so important and costly.

The Mayor responded that this item was Workshopped twice. He said this is not deficit spending. Bonds were issued with specific revenue sources identified to repay the bonds. As for the cause, the Council did inquire why this happened. Staff said that the contractor did not do borings for the entire field, but only for small portions. As they were digging they found unsuitable soil. The IEPA requires this type of testing, and unacceptable field conditions such as this occur on the spot. In the aggregate for 2009, the Change Orders are to the benefit of the Village. The work in this case has already been done. The Village is putting its water on the property.

Mr. Fieldman responded that the soil was unsuitable in that it is wet and silty and will not support the end use of a soccer field.

The Mayor noted that this is the Village’s responsibility, under the terms of the intergovernmental contract between the Village and Park District.

B. Comments and Questions on General Matters

Tom LeCren commented on the budget and said that he thought that everyone can be reasonably proud of the process. He suggested that the Council critique the process among themselves. He said the budget was well done, and they should be proud of themselves. He wished the Council a Merry Christmas as well as extended best wishes to the staff.

Mayor Sandack responded that they intend to critique this, and it would be done in a public meeting.

11.Council Member Reports and New Business

Commissioner Beckman commented that this has been an extraordinary year everywhere. The national economic situation has caused everyone, including the Council, to rethink how they conduct business; however, he said that we are in a period of reflection and a time of rebirth. He asked everyone to keep those they love as safe as they can from harm. He asked that people share with each other, and extended Happy Holidays to everyone.

Commissioner Neustadt asked the public to remember that police and firefighters serve and protect the residents 365 days a year. He extended a special Merry Christmas and Happy Holidays to them, as well as to the Council and residents.

Commissioner Waldack said he mentioned a few weeks ago that the Council is a group of community leaders. In a community this size, there are many leaders, including religious leaders. He recognized Reverend Laura and Reverend Bill Hoglund of the First Congregational Church of Christ. Rev. Laura has served for 33 years, and Rev. Bill for 16 years. Their work has extended beyond their congregation. Commissioner Waldack said that December 24 will be their last service in Downers Grove, as they are moving to LaCrosse, Wisconsin. Reverend Bill has said he will refuse to become a Packers fan. Commissioner Waldack thanked them for their service to the community and extended best wishes to them. Commissioner Waldack then wished everyone a Merry Christmas, Happy New Year and extended best wishes for the best in 2010.

Commissioner Barnett joined in wishing everyone a Merry Christmas. This is a good time to remember those less fortunate and reach out to others. There is a lot for this community to be proud of. He said that he attended a Community Events Committee meeting today, and there was a roomful of people looking to contribute to our community.

Commissioner Schnell said that the Village is fortunate to have a great group of employees and volunteers. She extended happy holiday wishes to everyone.

Commissioner Durkin commented on the change order discussion, saying that Mr. Wrobel asked some good questions. There were many questions Commissioner Durkin said that he asked as well. He pointed out that due to the way the Village bids work, there will be times when a change order will be in the Village’s favor. He said that information will be shared with the Council and the public. He thanked the staff for the research they did for him. He then asked that everyone mark their calendar for February 13 and February 14 when the Ice Festival will take place in the Central Business District with the help of the EDC , Downtown Management and the Chamber of Commerce. It will not be funded by the Village. He wished everyone a Happy Holiday season and a Merry Christmas.

Mayor Sandack thanked Laura and Bill Hoglund for all they have given to the community. They have been terrific members of the community. He said that Commissioner Durkin made a good point, noting that the void of the Ice Festival brought people together to act quickly and preserve this event and find funds to make it happen. He hopes the same will occur for Heritage Festival, the bike race and other community events. In Downers Grove, the best is yet to come in terms of community events. 12. Adjournment

Commissioner Schnell moved to adjourn to Executive Session pursuant to Section 2©(11) of the Open Meetings Act to consider pending litigation. Commissioner Barnett seconded.

Mayor Sandack declared the motion carried and the Council convened into Executive Session at 7:28 p.m.
