1. Call to Order

Mayor Brian Krajewski called the regular meeting of the Village Council of the Village of Downers Grove to order at 6:30 p.m. in the Council Chambers of the Downers Grove Village Hall.

3. Minutes of Workshop and Council Meetings

Executive Session Minutes for Approval Only – April 17, 2001 & April 25, 2001 Council Meeting – May 1, 2001 Workshop Meeting – May 8, 2001 Special Council Meeting – May 8, 2001 Commissioner Tully referenced paragraph three on page 11. He asked that the first sentence be corrected as follows: ”...it is important for the Zoning Commission to know what the Master Plan is for Ogden Avenue….” Regarding the sixth paragraph on page 24, he asked that the second sentence be corrected as follows: ”...give fair notice to the developer that there will be further public review and input.”

There being no further additions or corrections to the minutes, Mayor Krajewski said they would be filed as corrected.

LEARN NOT TO BURN POSTER CONTEST AWARD PRESENTATIONS

Mayor Krajewski announced the winners of the Fire Department’s Annual Learn Not to Burn poster contest. Marsha Giesler of the Fire Department said this was the tenth time she has been involved in this program. She explained that the thrust of the Fire Department’s school program is the third grade. The fourth graders are visited only once. She said that this year the 4th graders have taken the contest to a new level using the Internet to research tips on fire safety. There were so many that a new award level has been added for the “greatest number of fire safety and prevention tips.” Ms. Giesler thanked everyone for taking time out of their school schedules and their Christmas breaks to work on these projects.

RES00 -00449 Resolution: Lot Split – 4346 Cumnor Road Sponsors: Plan Commission Summary of Item: At their meeting of March 6, 2001, the Plan Commission unanimously recommended that a lot split with a flag lot be granted for 4346 Cumnor Road. This is subject to the condition that the existing garage structures located at 4346 Cumnor Road be razed and that no building permit will be issued for any new structure for either lot created by this lot split until this condition is met.

RESOLUTION 2001 -41 Commissioner Tully stated he was not on the Council when this was Workshopped, and he was not generally in favor of flag lots; however, he looked at the Ordinance and lots in the Village that might be eligible under the Ordinance. He was surprised that there were 64 lots in the Village that could qualify for flag lot treatment under this Ordinance. He said he did not think it was fair to penalize the petitioners in this case and he would support this petition; however, he requested and recommended that staff review the existing flag lot ordinance again for possible changes.

Commissioner Zabloudil said he had similar concerns as Commissioner Tully and agreed that they need to review that Ordinance He agreed it was not fair to penalize this petitioner.

Commissioner Gilbert said he would vote “no” as he believes the discretion lies with the Council. He believes this case cuts new ground in this particular area. Although he realizes it would be a hardship to the petitioner, he cannot justify this for this area.

Commissioner Schnell said she drove through the area and said she believed the flag lot proposed would have less effect than she thought it would on this area. However, she also agreed with the previous comments to pursue review of the Ordinance. She also agreed it would be unfair to deny the request of this petitioner.

Commissioner McConnell said she agreed with everything already said and is in favor of a review.

Commissioner Sisul said he reviewed the minutes of 1991/1992 when the Ordinance was established. He said the concerns today are similar to those expressed in 1991 and 1992. He agreed with reviewing the flag lots again, and said their might be new ways of looking at the issues at this time.

The Mayor said he also had problems with flag lots, but did not see how under the current Ordinance they could deny this petition. He asked the Village Manager to have staff review the Ordinance. ORD00 -00476 Ordinance: Amend the Municipal Code re: Community Events, Community Grants and Tourism Sponsors: Village Attorney Summary of Item: This will result in the restructuring of the Visitor’s Bureau and Community Events Commission in order to create two new commissions – the Community Grants Committee and the Tourism and Events Commission.

AN ORDINANCE AMENDING THE DOWNERS GROVE MUNICIPAL CODE RELATED TO COMMUNITY EVENTS , COMMUNITY GRANTS AND TOURISM

ORDINANCE NO . 4294 Commissioner Schnell stated she would vote “no” for this Ordinance as it dilutes the purpose of the Visitors Bureau as proposed by McNulty Cummings. She does not want to see it diluted. In addition, she thinks the Village worked too long and too hard to put the Visitors Bureau in place. She said she spoke with the ex-Chair of the Visitors Bureau, and he told her there was a need for hotels to attract overnight stays through increased regional and national events, or working with the business community for overnight stays. She does not believe the proposed Ordinance promotes those needs. The Commissioner said she also did not think they were looking at the future when staff may change. If there is a desire for more national and regional events coming to the Village, she believes they need to Workshop this issue to get more residents involved. She appreciates the work of the Staff and Commissioner Gilbert for working on this and sharing the information with her. A motion was made, seconded by Commissioner Tully, to Adopt this file. New Business

Proclamations:

1. The Mayor declared May 13-19, 2001 as Police Week in the Village of Downers Grove. He encouraged the citizens to support the service of the Police Department to the Village of Downers Grove, and asked them to observe May 15 as Police Officers’ Memorial Day. He noted a ceremony was held last Thursday at Barth Pond.

2. The Mayor declared May 23, 2001 as Turkey Town in the Village of Downers Grove and invited everyone to attend the Butterball Thanksgrilling at Fishel Park on Wednesday, May 23 at 11:00 a.m.

9. Manager’s Report

1. Manager Ginex said on Friday two firefighters from the Village will be in Springfield receiving the State of Illinois Medal of Valor for their part in rescuing a young girl. 2. The Manager announced that Saturday will be the annual Police Open House from 9:00 a.m. to 1:00 p.m. He said the displays would be held outside with numerous demonstrations, a silent auction, and refreshments for purchase. The proceeds will go toward the purchase of car seats.

The Mayor added that Coffee With the Council will be held at the Police Department.

10. Attorney’s Report

a. Attorney Blondin said that a public hearing will be held on May 22 regarding Intention to Request Quick Take Authority.

b. Attorney Blondin requested waiving the one-week waiting period for the authorization of purchasing property at the corner of Carpenter and Gilbert to effect a continuous strip of property. The addresses effected in the purchase and exchange are 5115 Carpenter and 1111 Gilbert. The appraisals of the property were very close. Commissioner Sisul moved to waive the one week waiting period to discuss new business. Commissioner Gilbert seconded the Motion.

11. Council Member Reports and New Business

1. Commissioner Tully said he was looking forward to the Police Open House, and his six-year old son was excited about seeing Passo again He also said the web site has been updated.

2. Commissioner McConnell said the Partnership for Healthier Communities met last week with two presentations. District 99 presented the topic of Alcoholic Substance Use in High Schools. She said that there is a fair amount of alcohol use and they need to continue to address this issue. The second presentation by the local Police Department was made by Officer Dan Ferraro. He discussed Internet Safety and the types of issues there are. He made an excellent presentation and will be offering a course through the Park District in the fall for parents. She recommended that he come to the Council as well.

3. Commissioner Gilbert said that this evening the Council approved the annexation agreement of Downers Grove Estates. He said one property owner has had plans drawn and applied through the County for construction permits. With annexation to the Village there is ambiguity between the County and Village ordinances regarding height. In this case, the normal process would be that the owner would have to go through the Zoning Board of Appeals. He asked staff to review and make recommendations in cases such as this where there is pending annexation involved. He would like to see the petitioners come directly to the Council for approval. He asked that this issue be placed on Workshop as early as next week if possible. Commissioner Gilbert said the owner will be penalized financially and in terms of time delays if he is not allowed to move forward.

The Mayor said he spoke to the Village Manager on Monday. There are about 80 houses coming in this evening and another 200 later. He was approached on Saturday by two owners who are doing work on their home at the present time, under approval by the County. He said they need to address the issue of people who are in the middle of construction with the Council and asked the Village Manager to have staff address this issue.

Commissioner Schnell said she thought that Mr. Rathje indicated if the owners had actually received the permit, they could proceed with the work. The ambiguity occurs where there is no permit.

Commissioner Tully asked about the County’s position in respect to the County’s involvement once the annexation occurs. Do they stop going through the permitting process. Attorney Blondin said they cease acting as the permitting agent at that time. It is complicated matter as an individual can manipulate the process if they choose to do so.

Commissioner Gilbert said it still falls within the Council’s purview to accept or not accept a request. He would like to make sure that there is a way to facilitate an easier transition for those who have started work under a County permit.

Commissioner Tully said they need to have a clearly defined policy.

Commissioner Sisul said he agrees that a policy is needed. He recommended to set something up to provide guidance to the staff so each situation does not have to come before the Council.

Attorney Blondin said that the Council has not been involved in building permits. The Council cannot waive the zoning mandate but could establish a mechanism for recently annexed property.

The Mayor said they need to address this issue as it relates to the southwest side.

Commissioner Gilbert then announced that on June 1 tickets for the Heritage Festival go on sale at a cost of $19.00 for 40 tickets. He noted there will be an increased number of rides from 18 to 22, and each night at 9:30 p.m. there will be a fireworks display. There are 36 days until the next Heritage Festival.

4. Mayor Krajewski reminded everyone about the Police Open House on Saturday. He noted that Passo’s handler has been injured. Manager Ginex said that Passo and his handler will be there.

The Mayor then congratulated the firefighters for their receipt of the Medal of Valor. This is the second time in three years that Village firefighters have received this award.

The Mayor said he was going to Pierce Downer School tomorrow for lunch to meet with the Student Council and their problem solving group.
